Local Law 84, Local Law 133, and Local Law 33

buildings > 50,000 SF 2009 requirements

 

Local Law 133:

buildings > 25,000 SF a 2016 requirements

 

Local Law 33:

buildings > 25,000 grade and score

New York City requires annual benchmarking for buildings over 25,000 GSF. Such buildings are needed to get an energy efficiency score and energy efficiency grade and display it in a conspicuous public entrance of the building. Collectively, Local Law 84, 133, and 33 covers these requirements.

Local Law 84, introduced in 2009, requires building over 50,000 GSF to submit an annual report of energy and water consumption data to the city on May 1st. PCA will send a benchmarking report to the city using the  Energy Star Portfolio Manager.

Owners who fail to submit benchmarked data to the city will face a maximum annual fine of $2000 per property.

 

Local Law 133, introduced in 2016, expands Local Law 84 to require buildings over 25,000 GSF to benchmark annual energy and water consumption data and report to the city.  Owners who fail to submit benchmarked data to the city will face a maximum annual fine of $2000 per property.

 

Local Law 33 will require owners covered in LL 84 and LL 133 to obtain an energy efficiency grade and an energy efficiency score and to display it in a conspicuous location near each public entrance to the building.

The Energy Star Portfolio Manager will provide an Energy Star Rating. Grades based on Energy Star energy efficiency scores will be assigned as follows:

A – score is equal to or greater than 85;

B – score is equal to or greater than 70 but less than 85;

C – score is equal to or greater than 55 but less than 70;

D – score is less than 55;

F – for buildings that did not submit required benchmarking information;

N – for buildings exempted from benchmarking or not covered by the Energy Star program.
